Welcome to ChileBeds.com. These Terms of Service ("Terms", "Agreement") govern your access to and use of our website, reservation systems, and physical hotel facilities located in Santiago, Chile. By accessing our website or booking a stay with us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Introduction and Scope

These Terms apply to all users of the ChileBeds website, including guests, visitors, and booking agents. The services provided by ChileBeds include accommodation, fine dining, spa and wellness facilities, event hosting, and supplementary evening entertainment.

We reserve the right to amend these Terms at any time without prior notice. The updated version will be indicated by an updated "Last Updated" date, and the updated version will be effective as soon as it is accessible.

2. Booking and Reservations

2.1 Reservation Process

All reservations are subject to availability. A booking is only confirmed once you receive a formal confirmation email from ChileBeds containing your reservation number and details. We reserve the right to refuse any booking request at our sole discretion.

2.2 Pricing and Taxes

All rates quoted on our website are in US Dollars (USD) or Chilean Pesos (CLP) unless otherwise specified. Rates include applicable room charges but may not include local municipal taxes, VAT (IVA), or additional service charges, which will be detailed during the checkout process. Foreign tourists paying in USD may be exempt from the 19% Chilean VAT (IVA) upon presentation of a valid passport and tourist card at check-in.

2.3 Payment Policy

A valid credit card is required to secure your reservation. Depending on the rate selected, a deposit or full prepayment may be charged at the time of booking. By providing your payment information, you authorize ChileBeds to charge the applicable fees to your designated payment method.

3. Cancellation and Modification Policy

We understand that travel plans can change. Our cancellation policies vary based on the room rate and season:

  • Flexible Rates: Cancellations made up to 48 hours before the scheduled check-in date will not incur a penalty. Cancellations made within 48 hours will be charged for the first night's stay.
  • Non-Refundable Rates: These bookings require full prepayment and cannot be cancelled, refunded, or modified under any circumstances.
  • No-Shows: If you fail to arrive on your scheduled check-in date without prior notice, your reservation will be cancelled, and you will be charged the full amount of the booking.

Modifications to dates or room types are subject to availability and potential rate adjustments.

4. Check-in and Check-out

  • Check-in time: 3:00 PM local time.
  • Check-out time: 12:00 PM (Noon) local time.

Early check-in and late check-out requests are subject to availability and may incur additional charges. Upon check-in, all guests must present a valid government-issued photo identification (Passport or Chilean Cédula de Identidad) and a valid credit card for incidental charges.

5. Hotel Policies and Guest Conduct

5.1 General Conduct

Guests are expected to conduct themselves in a respectable manner and not to cause any nuisance or annoyance to other guests. We reserve the right to ask any guest to leave the hotel without a refund if their behavior is deemed unacceptable or violates local laws.

5.2 Age Restrictions and Facilities

The primary guest making the reservation must be at least 18 years of age. Access to certain hotel amenities is strictly regulated:

  • Spa and Wellness: Access to the sauna and specific spa treatments is restricted to guests aged 16 and older.
  • Evening Entertainment: Our private casino lounge is offered as an optional, supplementary entertainment feature. Access to this specific area is strictly limited to registered guests who are 18 years of age or older. Valid ID must be presented upon entry. ChileBeds promotes a responsible and relaxed environment; disruptive behavior in this lounge will result in immediate revoked access.

5.3 Smoking Policy

ChileBeds is a 100% smoke-free environment indoors, including all guest rooms, balconies, and public areas. Smoking is only permitted in designated outdoor areas. A deep cleaning fee of $250 will be charged to the room account of any guest found smoking in a non-designated area.

5.4 Pets

While we love animals, strictly no pets are allowed on the hotel premises to ensure the comfort of all our guests, with the exception of certified service animals required by law.

6. Limitation of Liability

To the maximum extent permitted by applicable law, ChileBeds, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the website or hotel services;
  • Any conduct or content of any third party;
  • Any loss of or damage to guests' personal property (safes are provided in all rooms for valuables).

Our total liability for any claim arising out of or relating to these Terms or the services provided shall not exceed the total amount paid by you to ChileBeds for the specific reservation in question.

7. Force Majeure

ChileBeds accepts no liability and will not pay any compensation where the performance of our obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond our reasonable control. Such circumstances include, but are not limited to, natural disasters, acts of terrorism, war, civil unrest, strikes, government regulations, or disruption to utility services.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Chile, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your stay at the hotel shall be subject to the exclusive jurisdiction of the courts located in Santiago, Chile.

9. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
